1. Agreement to Terms

Welcome to Tubara! These Terms of Service ("Terms") govern your use of the Tubara platform, website, and services (collectively, the "Service").

By creating a Tubara account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use Tubara.

These Terms constitute a legally binding agreement between you and Tubara. Please read them carefully.


2. Service Description

2.1 What Tubara Provides

Tubara is a parent-controlled educational video platform that allows parents and guardians to:

  • ✅ Curate safe, educational YouTube content for their children
  • ✅ Create individual child profiles with age-appropriate filtering
  • ✅ Monitor screen time and viewing habits through detailed analytics
  • ✅ Control which YouTube channels their children can access
  • ✅ Set and enforce screen time limits
  • ✅ Review children's watch history and learning patterns
  • ✅ Approve or reject content before children can access it

2.2 What Tubara Is NOT

Tubara is not:

  • ❌ A content creation or hosting platform (we embed YouTube videos; we don't host or create content)
  • ❌ A substitute for parental supervision (you remain responsible for monitoring your children)
  • ❌ A guarantee that all approved content will always remain appropriate (YouTube channels may upload new content)
  • ❌ A YouTube alternative (we rely entirely on YouTube's infrastructure and API)
  • ❌ A social media platform (no comments, shares, likes, or social features)
  • ❌ An entertainment streaming service (we focus on educational content only)

Parental responsibility: You remain fully responsible for supervising your children's use of Tubara and approving appropriate content. Tubara is a tool to assist you, not replace you.


3. Eligibility

3.1 Age Requirements

To create a Tubara account, you must:

  • Be at least 18 years old
  • Be the parent or legal guardian of any children who will use the Service
  • Have the legal authority to enter into these Terms on behalf of yourself and your children
  • Provide accurate age verification (via payment method)

Children under 18: - Cannot create Tubara accounts independently - Cannot modify settings or approve content - Must use the Service only under parental supervision and control

3.2 Geographic Restrictions

Tubara is currently available in:

  • 🇬🇧 United Kingdom
  • 🇪🇺 European Union (all member states)
  • 🇺🇸 United States
  • 🇨🇦 Canada
  • 🇦🇺 Australia
  • 🇳🇿 New Zealand

We reserve the right to: - Restrict access from other jurisdictions - Expand availability to new regions at our discretion - Modify geographic restrictions based on legal requirements

Access from restricted regions may result in account suspension or termination.

3.3 Account Representation and Warranties

By creating an account, you represent and warrant that:

  • ✅ All information you provide is accurate, current, and complete
  • ✅ You are the parent or legal guardian of all children whose profiles you create
  • ✅ You have the legal right to provide consent on behalf of your children
  • ✅ You will maintain the security of your account credentials
  • ✅ You will comply with all applicable laws and regulations
  • ✅ You will not use the Service for any illegal or unauthorized purpose
  • ✅ You will supervise your children's use of the Service

False representations may result in immediate account termination.


4. Account Registration and Security

4.1 Account Creation

To use Tubara, you must:

  1. Provide a valid email address (verified before access is granted)
  2. Create a secure password (minimum 8 characters)
  3. Agree to these Terms and our Privacy Policy
  4. Complete payment method verification (for COPPA adult verification - no charge for trial/free tier)
  5. Confirm you are 18+ years old and the parent/guardian of children using the Service

Email Verification: - You must verify your email address before full access is granted - We will send a verification link to your email - Verification links expire after 24 hours

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activities that occur under your account, even if unauthorized
  • Notifying us immediately of any unauthorized access or security breach
  • Using strong, unique passwords not shared with other services
  • Protecting your login credentials from children and third parties
  • Logging out after each session on shared devices

Security best practices: - Use a password manager - Enable two-factor authentication when available (future feature) - Don't share your password with anyone, including family members - Change your password if you suspect compromise

We are not liable for any loss or damage arising from: - Unauthorized access to your account due to your failure to maintain security - Your sharing of credentials with others - Your use of weak or compromised passwords

4.3 Account Termination by You

You may delete your account at any time through:

  • Account Settings > Delete Account (instant)
  • Email request: support@tubara.world (processed within 48 hours)

Upon deletion: - ✅ Your account and all children's profiles will be permanently deleted - ✅ All personal data will be removed within 30 days (GDPR compliance) - ✅ Your subscription will be canceled immediately - ❌ No refund for partial months (see Section 5.3 Refund Policy) - ✅ Backups containing your data will be overwritten within 90 days - ✅ You will receive email confirmation of deletion

Data retention exceptions: - Payment transaction records: Retained for 7 years (UK tax law requirement) - Legal dispute records: Retained as required by law

4.4 Account Termination by Us

We may suspend or terminate your account immediately if:

  • ❌ You violate these Terms
  • ❌ You provide false or misleading information
  • ❌ Your account is used for illegal activities
  • ❌ Your payment method fails repeatedly (after 3 attempts)
  • ❌ We are required to do so by law or court order
  • ❌ You engage in abusive behavior toward our staff or other users
  • ❌ You attempt to circumvent security measures or parental controls
  • ❌ You use automated tools to scrape or abuse the Service

Notice: - We will provide reasonable notice when possible (typically 7 days) - We reserve the right to terminate immediately for serious violations - You will receive email notification of termination and reason (when legally permitted)

Effect of termination: - Immediate loss of access to the Service - No refund for remaining subscription period (except where required by law) - Permanent deletion of all data within 30 days

Appeals: If you believe your account was terminated in error, contact legal@tubara.world within 14 days.


5. Subscription Plans and Payments

5.1 Subscription Tiers

Tubara offers the following subscription plans:

Currency: - Prices listed are in GBP (British Pounds Sterling) - Equivalent pricing in other currencies will be charged based on current exchange rates - Prices include VAT where applicable

Prices are subject to change with 30 days' advance notice.

5.2 Payment Terms

Billing: - Subscriptions are billed monthly in advance on the date you subscribe - Payments are processed securely through Stripe (we do not store your card details) - You authorize recurring charges to your payment method until you cancel - Billing occurs automatically on the same day each month

Payment Methods: - ✅ Credit card (Visa, Mastercard, American Express) - ✅ Debit card - ✅ Apple Pay / Google Pay (where supported by Stripe) - ✅ Other methods supported by Stripe

Payment Method Verification: - All users (including trial and free tier) must verify a payment method - This is required for COPPA adult verification (confirming you are 18+) - Free tier users are not charged; verification is for age confirmation only

Failed Payments: - If payment fails, we will attempt to charge again within 3 days - You will receive email notification of failed payment - After 3 failed attempts, your account may be downgraded to Free tier or suspended - You remain responsible for any unpaid fees - Late fees do not apply, but we reserve the right to pursue collection for unpaid balances

Updating Payment Information: - Update your payment method in Account Settings > Billing - Changes take effect on the next billing cycle

5.3 Refund Policy

No Refunds for Partial Months: - Subscriptions are non-refundable - If you cancel, you retain access until the end of your current billing period - No pro-rated refunds for partial months - Cancellation takes effect at the end of the billing cycle

Exceptions:

1. Service Disruption: If we make material changes to the Service that negatively impact core functionality, you may request a refund: - Must request within 14 days of the change - Must provide explanation of how the change affects you - Refund at our discretion

2. Billing Errors: If we incorrectly charge you due to a system error: - We will refund the error amount in full - Refund processed within 7 business days - No request needed; we will proactively refund

3. Account Termination by Us (Our Fault): If we terminate your account due to our error: - You will receive a pro-rated refund for unused time - Refund processed within 14 days

Refund Method: - Refunds issued to the original payment method - Processing time: 5-10 business days (depending on your bank)

5.4 14-Day Free Trial

Trial Terms:

  • ✅ New users receive a 14-day free trial with access to all Unlimited features
  • ✅ Credit/debit card verification required (confirms adult status - COPPA requirement)
  • No charges during the trial period
  • ⚠️ Trial automatically converts to Free tier (£0.00/month 5 channels/ 2 channel changes per month) unless you cancel or choose a different tier
  • ✅ Cancel anytime during the trial with zero charges
  • One trial per user/household (tracked by email and payment method)

How to Cancel Trial: - Account Settings > Cancel Subscription (instant) - Email: support@tubara.world (process within 24 hours)

Trial Eligibility: - First-time users only - One trial per email address - One trial per payment method - We reserve the right to deny trials to users who abuse the system

After Trial Ends: - If you don't cancel: Your access is automatically reduced to Free tier (£0.00/month) - You can upgrade at any time - You can cancel after being billed (no refund for that month)

5.5 UK Consumer Rights (Distance Selling Regulations)

14-Day Cooling Off Period (UK/EU Consumers):

Under UK Consumer Contracts Regulations 2013 and EU Consumer Rights Directive, you have the legal right to cancel your subscription within 14 days of signing up and receive a full refund, UNLESS:

  • ✅ You expressly requested immediate access to the Service
  • ✅ You acknowledged that you lose your right to cancel once you begin using the Service

By clicking "I Agree" during signup, you: - ✅ Request immediate access to Tubara (no 14-day waiting period) - ✅ Acknowledge you lose the cooling-off right once you create child profiles or approve channels - ✅ Understand this does not affect your right to cancel your subscription going forward (just no refund)

This means: - Once you create a child profile or approve a channel, the 14-day refund right is waived - You can still cancel anytime, but receive no refund for the current month - This is standard for digital services that you begin using immediately

After 14 days or after using the Service: - Standard cancellation terms apply (Section 5.3) - No refund for partial months

5.6 Price Changes

We may change subscription prices with:

  • 30 days' advance notice via email
  • Explanation of reason for price change
  • Right to cancel: You may cancel if you don't agree to new pricing (no penalty)

How We'll Notify You: - Email to your registered email address - Notice in your account dashboard - Message when you next log in

Your Options: - ✅ Accept new pricing (continue as normal) - ✅ Cancel subscription before price change takes effect - ✅ Downgrade to a lower tier


6. Service Usage and Restrictions

6.1 Permitted Uses

You may use Tubara to:

  • ✅ Create child profiles for your own children or children in your legal care
  • ✅ Curate educational YouTube content for your family
  • ✅ Monitor your children's viewing habits and screen time
  • ✅ Set and enforce screen time limits
  • ✅ Access parental analytics and learning insights
  • ✅ Export your data for personal use
  • ✅ Contact support for assistance

6.2 Prohibited Uses

You may NOT:

Account and Access Restrictions: - ❌ Share your account with others outside your household - ❌ Create accounts for children who are not your own (without guardian permission) - ❌ Create multiple accounts to abuse free trials or promotions - ❌ Sell, rent, or transfer your account to others - ❌ Allow others to use your account credentials

Technical Restrictions: - ❌ Circumvent age restrictions or parental controls - ❌ Attempt to access other users' accounts or data - ❌ Reverse engineer, decompile, disassemble, or modify the Service - ❌ Use automated tools, bots, scrapers, or robots to access the Service - ❌ Bypass security measures or authentication systems - ❌ Interfere with or disrupt the Service or servers - ❌ Attempt to gain unauthorized access to any systems or networks

Content and Usage Restrictions: - ❌ Use the Service for commercial purposes without written permission - ❌ Resell, redistribute, or sublicense access to Tubara - ❌ Upload malware, viruses, or harmful code - ❌ Use the Service to harm, harass, or abuse others - ❌ Violate any applicable laws or regulations - ❌ Infringe on intellectual property rights - ❌ Misrepresent your identity or relationship to others

Household Definition: "Household" means individuals living at the same primary residence. Exception: Divorced parents with shared custody may use one account across two households for their shared children.

Violation of these restrictions may result in: - Immediate account suspension or termination - No refund of subscription fees - Legal action if laws are violated - Reporting to law enforcement if necessary


7. Content and YouTube Integration

7.1 Third-Party Content

YouTube Videos:

  • All video content is provided by YouTube and subject to YouTube's Terms of Service
  • Tubara does not host, create, or own any video content
  • We are not responsible for:
  • Accuracy, legality, or appropriateness of YouTube content
  • Availability or removal of videos by YouTube
  • Changes to YouTube's Terms of Service or API
  • YouTube outages or service interruptions

7.2 Content Curation and Your Responsibility

Your Responsibility:

You are solely responsible for: - Reviewing and approving all channels before your children access them - Monitoring approved channels for new content that may be uploaded - Removing channels immediately if inappropriate content appears - Supervising your children's use of the Service - Setting appropriate age ranges for each child profile

Important Limitations:

  • ⚠️ Tubara provides age-filtering as a tool, not a guarantee
  • ⚠️ No automated system is 100% accurate
  • ⚠️ YouTube channels may upload new content at any time without notice
  • ⚠️ Content that was appropriate yesterday may not be appropriate today
  • ⚠️ You should preview channels before approving them for your children

Best Practices: - Periodically review your approved channel list - Watch sample videos from each channel before approving - Remove channels if quality declines or content changes - Use age ranges as a starting point, not absolute protection - Supervise younger children more closely

7.3 Content Removal and Changes

YouTube may remove or modify content at any time:

  • If a video is removed by YouTube, it will no longer be available on Tubara
  • If a channel is terminated by YouTube, it will disappear from your approved list
  • We have no control over YouTube's content moderation decisions
  • We are not liable for content removal or changes made by YouTube

What we do when content is removed: - Remove broken video links from your watch history - Update your analytics to reflect removed content - Notify you if entire channels are terminated (when possible)

7.4 Reporting Inappropriate Content

If you discover inappropriate content:

Immediate Action: 1. Remove the channel from your approved list immediately 2. Delete the child profile's watch history if needed 3. Talk to your child about what they saw

Report to Tubara: - Email: support@tubara.world - Include: Channel name, video URL, description of issue - We will: Review and potentially blacklist the channel from our recommended lists

Report to YouTube: - All content issues should be reported directly to YouTube - Report link: https://www.youtube.com/reportabuse - YouTube can remove videos and terminate channels

We appreciate reports but cannot guarantee YouTube will take action.


8. Parental Responsibility

8.1 Supervision

You acknowledge and agree that:

  • Tubara is a tool to assist with parental supervision, not a replacement for it
  • You remain fully responsible for monitoring your children's online activities
  • Technology cannot replace human judgment in determining appropriate content
  • You should periodically review approved channels for new uploads
  • Active supervision is especially important for younger children
  • You should talk to your children about what they watch and learn

Tubara Cannot: - Monitor your children in real-time - Know your family's specific values and standards - Predict what content YouTube channels will upload next - Replace conversations between parents and children about internet safety

8.2 Age-Appropriate Content

Content Filtering Limitations:

  • Our age filters are based on YouTube's metadata, channel categories, and our own classification
  • No automated system is 100% accurate
  • Content that appears educational may still be inappropriate for some children
  • YouTube channels vary widely in quality and appropriateness
  • Cultural differences affect what's considered "age-appropriate"

Your Responsibility: - Preview channels before approving them for your children - Use age ranges as guidelines, not absolute rules - Consider your child's maturity level, not just their age - Remove channels if content quality declines - Adjust age ranges if content seems too advanced or too simple

We recommend: - Start with well-known educational channels - Watch a few videos from each channel before approving - Check channel upload frequency and recent videos - Read other parents' reviews of channels (outside Tubara)

8.3 Screen Time Management

Screen Time Limits:

  • You set screen time limits for each child profile
  • Limits are enforced by Tubara (videos stop when limit reached)
  • You can override limits as the parent when needed
  • We provide tools and analytics, but ultimate responsibility lies with you

Best Practices: - Follow WHO/AAP guidelines (maximum 1-2 hours per day for children) - Set consistent limits and stick to them - Use screen time as a reward, not a default activity - Balance screen time with physical activity and social interaction - Monitor what children watch, not just how much

We Provide: - Daily and weekly screen time reports - Real-time usage tracking - Automatic video stopping when limit reached - Parent override capability for special circumstances


9. Intellectual Property

9.1 Tubara's Intellectual Property

We own all rights to:

  • ✅ The Tubara platform, software, source code, and algorithms
  • ✅ Tubara branding, logos, trademarks, and service marks
  • ✅ Original content, documentation, and guides created by Tubara
  • ✅ User interface design and user experience
  • ✅ Database structure and organization

You may NOT: - ❌ Copy, modify, adapt, or create derivative works of our platform - ❌ Use our trademarks, logos, or branding without written permission - ❌ Remove copyright, trademark, or proprietary notices - ❌ Decompile, reverse engineer, or disassemble our software - ❌ Use our intellectual property for commercial purposes

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Tubara for personal, non-commercial use in accordance with these Terms.

9.2 YouTube's Intellectual Property

YouTube owns:

  • All video content displayed through Tubara
  • YouTube trademarks, logos, and branding
  • YouTube API and infrastructure
  • YouTube's algorithms and recommendations (not used on Tubara)

You agree to comply with: - YouTube's Terms of Service: https://www.youtube.com/t/terms - YouTube's Community Guidelines - Copyright laws (DMCA and international equivalents)

Important: - Videos remain the property of their creators and YouTube - You do not gain any ownership rights by watching videos on Tubara - Copyright infringement should be reported to YouTube, not Tubara

9.3 Your Content and Feedback

User Feedback and Suggestions:

If you provide feedback, suggestions, ideas, or feature requests to Tubara:

  • ✅ You grant us a royalty-free, worldwide, perpetual, irrevocable license to use them
  • ❌ We are not obligated to implement any suggestions
  • ❌ You will not be compensated for feedback
  • ✅ You retain ownership of your original ideas, but we can use them freely

Why we need this: Many users suggest similar features. This clause protects us from claims that we "stole" an idea when we implement commonly-requested features.

No Confidential Submissions: Do not submit confidential information or proprietary business ideas. All feedback is considered non-confidential.


10. Privacy and Data Protection

10.1 Privacy Policy

Our comprehensive Privacy Policy explains how we collect, use, and protect your information and your children's information.

Key Privacy Principles:

  • 🔒 We encrypt all children's personal information (AES-256 encryption)
  • ✅ We comply with UK GDPR, EU GDPR, and US COPPA
  • ✅ You can delete all data at any time (within 30 days)
  • ❌ We do not sell data to third parties

By using Tubara, you agree to our Privacy Policy.

10.2 COPPA Compliance (US Users)

For US users with children under 13:

Verifiable Parental Consent: - You provide consent by creating an account and verifying a payment method - Payment verification confirms you are 18+ years old (adult verification) - This is an FTC-approved method under COPPA

Your COPPA Rights: - ✅ Review your child's personal information - ✅ Delete your child's personal information at any time - ✅ Refuse further collection of your child's information - ✅ Withdraw consent (by deleting account)

10.3 Data Security Acknowledgment

While we implement industry-standard security measures (encryption, access controls, secure hosting), you acknowledge that:

  • ⚠️ Internet transmission is never 100% secure
  • ⚠️ Unauthorized access or data breaches may occur despite our best efforts
  • ⚠️ No system can guarantee absolute security
  • ⚠️ You use Tubara at your own risk regarding data security

What we do: - Encrypt all sensitive data (AES-256) - Use secure connections (TLS 1.3) - Regular security audits - Prompt notification of any breaches (within 72 hours)

What you should do: - Use a strong, unique password - Don't share your login credentials - Log out on shared devices - Report suspicious activity immediately


11. Disclaimers and Limitations of Liability

11.1 Service "As Is" and "As Available"

TUBARA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • ❌ Warranties of merchantability
  • ❌ Warranties of fitness for a particular purpose
  • ❌ Warranties of non-infringement
  • ❌ Warranties arising from course of dealing or usage of trade

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results from using the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • All content will be appropriate or suitable for your children
  • Defects will be corrected promptly or at all
  • The Service will be compatible with all devices or browsers

You expressly agree that use of the Service is at your sole risk.

11.2 Third-Party Dependencies

Critical YouTube Dependencies:

Tubara relies entirely on YouTube's API and infrastructure. You acknowledge and agree that:

  • ⚠️ YouTube may restrict or terminate our API access at any time, without notice
  • ⚠️ YouTube Terms of Service changes may affect Tubara's functionality
  • ⚠️ YouTube outages, downtime, or performance issues will affect Tubara
  • ⚠️ We have no control over YouTube's operations, policies, or content moderation
  • ⚠️ YouTube may remove content or channels without warning

If YouTube Terminates Our API Access:

In the unlikely event that YouTube permanently terminates our API access and we cannot restore service:

  • ✅ We will notify you immediately via email
  • ✅ You will receive a full refund for unused subscription time (pro-rated)
  • ✅ We will work diligently to restore service or provide alternatives
  • ❌ This does not constitute a breach of contract by Tubara

Other Third-Party Dependencies: - Stripe (payment processing) - Cloud hosting providers (Vercel, Railway, Neon) - Email service (SendGrid)

We are not liable for failures or issues caused by these third-party services.

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We exclude and disclaim liability for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, data, or business opportunities
  • Loss of goodwill or reputation
  • Damages arising from your use or inability to use the Service
  • Third-party content, actions, or omissions (including YouTube)
  • Unauthorized access to your account (if due to your failure to secure credentials)
  • Viruses or malicious code from third-party sources
  • Service interruptions or downtime
  • Errors, mistakes, or inaccuracies of content

WE DO NOT EXCLUDE OR LIMIT LIABILITY FOR:

  • ❌ Death or personal injury caused by our negligence
  • ❌ Fraud or fraudulent misrepresentation
  • ❌ Breach of statutory rights that cannot be lawfully excluded under UK/EU consumer law
  • ❌ Any other liability that cannot be lawfully excluded or limited

Maximum Liability (Where Lawful):

Our total aggregate liability to you for any and all claims arising from or related to the Service shall not exceed:

The greater of: - (A) The amount you paid to Tubara in the 12 months preceding the claim, or - (B) £50 GBP

This limitation applies to all claims collectively, regardless of the form of action (contract, tort, negligence, strict liability, or otherwise).

Australian Consumer Law (ACL): Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be lawfully excluded.

11.4 Service Level Commitment

While we do not guarantee 100% uptime, we commit to:

Target Availability: - 99.5% monthly uptime (calculated as average across all users) - Excludes scheduled maintenance windows

Planned Maintenance: - Scheduled during low-usage hours (typically 2am-6am GMT) - Advance notice provided (minimum 24 hours) - Duration typically less than 2 hours

Status Updates: - Real-time status page: status.tubara.world (when available) - Email notifications for major outages - Updates posted to account dashboard

Service Credits (Downtime Exceeds 5% per month):

If we fail to meet 95% uptime in any calendar month (excluding planned maintenance):

  • You may request a pro-rated service credit for the affected period
  • Request via: support@tubara.world within 7 days of the outage
  • Credit applied to your next billing cycle
  • Calculated as: (Downtime hours / Total hours in month) × Monthly subscription fee
  • Maximum credit: One month's subscription fee

This is your sole remedy for service availability issues.

11.5 Indemnification

You agree to indemnify, defend, and hold Tubara harmless from:

Any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your violation of these Terms
  • Your violation of any third-party rights (including intellectual property, privacy, or publicity rights)
  • Your use of the Service (including any content you approve for your children)

US Users: You agree to resolve disputes individually, not as part of a class action, class-wide arbitration, or representative proceeding, except where prohibited by law.

UK/EU/Canadian/Australian/NZ Users: This clause does not apply. You retain all rights to bring representative, collective, or class actions under your local law.

Why We Have This (US Users): Class actions are expensive and time-consuming. Individual arbitration resolves disputes faster and more efficiently for both parties.

12.5 Jurisdiction and Venue

For legal proceedings (non-arbitrable disputes):

  • UK Users: Courts of England and Wales (with jurisdiction in your county of residence for consumer claims)
  • EU Users: Courts of your country of residence

This does not excuse payment obligations on your part.
